Artist Disclosure and Agreement
This section outlines the terms and conditions governing the display and sale of your artwork.
1. Release of Liability
The artist hereby agrees to release, indemnify, and hold harmless the East End Art Guild, its officers, directors, members, volunteers, and the venue where the artwork is displayed (hereinafter "the Venue") from any and all responsibility, liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, theft, damage, or destruction of artwork, whether such loss, theft, damage, or destruction occurs during transportation, display, storage, or at any other time while the artwork is on the Venue's premises or under the care of the Guild.
The artist understands and agrees that they are solely responsible for insuring their artwork against all risks of loss or damage.
2. Venue Commission
In consideration for the display and sale of artwork at the Venue, the artist agrees to offer a percentage of the final sale price of any artwork sold on the premises to the Venue, as follows:

For Retail Venues: The artist agrees to offer 10% (ten percent) of the final sale price. Should a retail venue decide not to accept this 10% commission, it would be admirable if the artist contributed that amount back to the Guild for the maintenance of the venue for which the Guild is responsible (e.g., painting, gallery system, wall repair, etc.).

For Exhibition Halls/Galleries: No commission is paid to the Venue for artwork displayed or sold in exhibition halls or galleries.
This commission (where applicable) shall be paid directly by the artist to the Venue upon the completion of a sale.
3. Artist's Responsibility for Transactions
All sales transactions, including but not limited to pricing, payment collection, and delivery arrangements, are the sole responsibility of the artist. The Guild and the Venue will not be involved in the financial aspects of the sale unless the artist expressly asks for assistance from the Guild in transferring the work to the buyer and collecting the payment. In such cases, all proceeds would then be transferred to the artist.
4. Tax Responsibility
The artist is solely responsible for collecting, reporting, and remitting any and all applicable taxes, including sales tax, to the appropriate tax authorities (e.g., Hacienda in Puerto Rico). The East End Art Guild and the Venue assume no responsibility or liability for the artist's tax obligations.
5. Guild's Non-Responsibility
The East End Art Guild acts solely as a facilitator for its members to display their art. The Guild assumes no responsibility or liability for the sale of artwork, the collection of funds, the payment of commissions, or any other aspect of the commercial transaction between the artist and the buyer.
By submitting artwork and participating in the display, the artist confirms that they have read, understood, and agree to all the terms and conditions set forth in this combined Artwork Submission and Disclosure Agreement.
